1. Eligibility
The Service is intended for authorised adults, including nursery owners and administrators, teachers and staff, and parents or legal guardians invited or approved by a nursery.
You must be at least 18 years old, or have reached the legal age required to enter into this agreement in your country. Nursery Pro is not a direct-to-child social service. Children must not create or independently operate accounts.
2. The Service
Nursery Pro is cloud-based childcare-management and communication software. Depending on the selected plan and authorised user role, it may provide:
- Enrolment and nursery records;
- Attendance and authorised-collection records;
- Childcare activities, reports, and daily updates;
- Messages, notices, photos, videos, and files;
- Administrative invoice or fee records without payment processing;
- Staff, nursery, and operational records;
- Notifications and communication between authorised users; and
- Related administration, reporting, and storage tools.
Features may differ by subscription, nursery, country, device, application version, or user role. Nursery Pro provides software only. It does not itself provide childcare, education, medical care, safeguarding supervision, transport, payroll, nursery services, or payment services.
3. Nursery responsibilities
Each nursery or organisation is responsible for:
- Complying with applicable childcare, safeguarding, employment, accounting, consumer-protection, privacy, and data-protection laws;
- Ensuring that information entered into the Service is accurate, relevant, and lawful;
- Obtaining all required notices, permissions, consents, and lawful grounds before recording or sharing child information;
- Deciding which staff, parents, guardians, or other users may access particular information;
- Promptly removing access when a user is no longer authorised;
- Maintaining its own policies for childcare, fees, admissions, cancellations, refunds, safeguarding, and record retention; and
- Independently verifying important information before making childcare, safety, health, legal, or financial decisions.
Nursery Pro does not replace a nursery's professional judgment, safeguarding procedures, statutory records, or legal duties.
4. Parent and guardian responsibilities
Parents and guardians must:
- Access only information for which they are authorised;
- Keep relationship, contact, and authorised-collector information accurate;
- Protect the privacy of children, staff, and other families;
- Not copy, publish, forward, or share photos, videos, messages, or records without proper permission; and
- Contact the nursery directly about childcare decisions, records, fee records, incidents, or safeguarding concerns.
A nursery may change or withdraw guardian access where lawful and appropriate.
5. Accounts and security
You must provide accurate account information and keep it current. You are responsible for activity through your account and must:
- Keep passwords, verification codes, and access links confidential;
- Not share an individual account with another person;
- Use reasonable device-security measures;
- Notify us and the relevant nursery promptly if you suspect unauthorised access; and
- Sign out of devices you no longer control.
We may require verification before granting access, changing account details, responding to a privacy request, or restoring an account.
6. Acceptable use
You must not:
- Access information without authorisation or bypass access controls;
- Upload unlawful, abusive, threatening, discriminatory, defamatory, exploitative, or child-harming content;
- Infringe privacy, confidentiality, intellectual-property, publicity, or other rights;
- Upload malware, disrupt the Service, or test vulnerabilities without written permission;
- Scrape, harvest, reverse engineer, copy, resell, or commercially exploit the Service except where law expressly permits;
- Impersonate another person or misrepresent a relationship with a child or nursery;
- Send spam, unauthorised advertising, or fraudulent requests;
- Use the Service for surveillance or profiling unrelated to legitimate childcare operations; or
- Use child photos, videos, health information, location information, or other child data for an unauthorised purpose.
We may investigate suspected misuse and cooperate with competent authorities where reasonably necessary and legally permitted.
7. Customer Content
Nurseries and users retain their rights in information, messages, photos, videos, files, and other content they lawfully submit ("Customer Content"). You grant Nursery Pro a limited, non-exclusive right to host, store, reproduce, transmit, display, back up, and otherwise process Customer Content only as reasonably necessary to provide, secure, support, maintain, and improve the Service; comply with lawful instructions; enforce these Terms; or meet legal obligations.
You confirm that you have the rights, permissions, and lawful grounds needed to submit Customer Content. Nursery Pro does not acquire ownership of Customer Content through these Terms. Each nursery remains responsible for its own decisions about collecting, recording, using, disclosing, and retaining childcare information.
8. Privacy and children's information
Our processing of personal information is described in the Nursery Pro Privacy Policy. The Service may process child and guardian relationships, attendance and care records, messages, media, and, where a nursery chooses to record them, allergy, medical, medication, consent, or other sensitive childcare details.
Nurseries must collect only information reasonably necessary for childcare operations and must have an appropriate legal basis and any required parental authorisation. General information in the Service is not medical, legal, or safeguarding advice. Account deletion and privacy requests are handled under the Privacy Policy. Some records may be retained with restricted access for legal, safeguarding, accounting, audit, dispute-resolution, or security purposes.
9. SaaS subscriptions and LemonSqueezy
Paid plans purchase access to Nursery Pro software only. They do not purchase childcare, nursery tuition, registration, transport, meals, or any other third-party service. LemonSqueezy acts as Merchant of Record exclusively for paid Nursery Pro software subscriptions. LemonSqueezy manages checkout, payment collection, applicable sales taxes, subscription billing, transaction receipts, and refunds processed through its systems under its own terms. Before purchasing, the customer must review the selected plan, price, billing period, included features, limits, and any applicable order form. Unless stated otherwise:
- Subscription fees are charged in advance;
- Prices exclude taxes or charges that must legally be added;
- Failure to pay may result in restricted or suspended access; and
- Clear pricing or billing errors may be corrected with notice to affected customers.
10. Automatic renewal
Where automatic renewal is selected, a subscription renews for the stated billing period unless cancelled before the renewal date. The customer authorises LemonSqueezy to collect the applicable recurring charge.
The customer is responsible for keeping billing information current. A failed payment does not cancel amounts already due. If a subscription price changes, the revised price applies from a future renewal after reasonable notice unless the customer expressly agrees otherwise.
11. No processing of nursery fees
Nursery Pro does not collect, route, hold, settle, split, transfer, or pay out tuition, registration, childcare, transport, meal, or other nursery fees. Nursery Pro does not enable nurseries to sell childcare services through LemonSqueezy.
Any invoice or fee information stored in Nursery Pro is maintained solely as an administrative record. Payments between a nursery and a parent occur independently outside Nursery Pro. LemonSqueezy is used exclusively to sell Nursery Pro software subscriptions directly to nurseries.
12. Cancellation and refunds
Customers may cancel through available account controls, the LemonSqueezy cancellation route shown in transaction communications or the customer portal where available, or by contacting contact@augmented-edu.com.
Cancellation prevents future renewals but does not automatically refund an amount already collected. Refund eligibility and processing are governed by the Refund and Cancellation Policy. Mandatory consumer rights remain unaffected.
13. Third-party services
The Service may rely on third parties for hosting, authentication, maps, notifications, analytics, crash reporting, subscription checkout, app stores, email applications, and video platforms.
Third-party services are governed by their own terms and privacy notices. We are not responsible for an independent third party's content, availability, acts, or omissions, except where responsibility cannot legally be excluded.
14. Availability and support
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Maintenance, security events, internet failures, third-party outages, device limitations, updates, or events outside our reasonable control may affect availability.
We may update, improve, replace, or discontinue features. If a change materially reduces a paid core feature during a current billing period, we will provide reasonable notice where practical and an appropriate remedy where required by law or written agreement. Support is provided through the channels and service levels stated on the website, selected plan, or separate written agreement.
15. Suspension and termination
We may restrict, suspend, or terminate access where reasonably necessary because:
- Fees remain unpaid;
- These Terms or applicable law have been materially or repeatedly breached;
- An account creates a security, privacy, safeguarding, fraud, or legal risk;
- Access is disputed by a nursery or guardian;
- A competent authority requires action; or
- Continued operation is no longer reasonably possible.
Where appropriate and lawful, we will provide notice and a reasonable opportunity to correct the issue. We may act immediately where needed to protect a child, user, the Service, or another person. Before organisational access ends, the nursery should export records it is entitled and required to retain. Information is then handled under the Privacy Policy, applicable law, and any written agreement.
16. Intellectual property
The Service, including its software, design, branding, logos, documentation, databases, and Nursery Pro-supplied content, is owned by or licensed to Augmented Education and protected by applicable law.
Subject to these Terms and applicable fees, we grant users a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purposes. No ownership rights are transferred. We may use feedback and suggestions without restriction or payment, provided we do not publicly identify you without permission.
17. Disclaimers
To the fullest extent permitted by law, the Service is provided on an "as available" basis. Nursery Pro does not guarantee that every feature meets every nursery's legal, regulatory, educational, medical, accounting, or safeguarding requirements.
The Service is an administrative and communication tool, not an emergency service. It must not be the only method for urgent, medical, safeguarding, attendance, collection, or safety communications. In an emergency, users must contact the nursery and appropriate authorities through proper channels. Nothing excludes a guarantee or remedy that cannot legally be excluded.
18. Limitation of liability
To the fullest extent permitted by law, Nursery Pro is not liable for indirect, incidental, special, punitive, or consequential loss, or loss of profit, revenue, goodwill, opportunity, or anticipated savings. To the fullest extent permitted by law, Nursery Pro's aggregate liability concerning a paid Service will not exceed the greater of:
- Subscription fees paid directly for that Service during the 12 months before the event giving rise to the claim; or
- QAR 500.
These limitations do not apply to fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, mandatory consumer rights, or another liability that cannot legally be limited. Nursery Pro is not responsible for childcare services, nursery decisions, user-generated records, or fees imposed by an independent nursery, except to the extent directly caused by Nursery Pro's own breach and not otherwise excludable.
19. Organisational responsibility for claims
To the extent permitted by law, an organisational customer is responsible for reasonable losses, claims, and expenses directly resulting from its unlawful Customer Content, failure to obtain required permissions, unauthorised disclosure through its accounts, or material breach of these Terms or applicable law.
This does not require compensation for loss caused by Nursery Pro's own breach, negligence, or unlawful conduct.
20. Changes to these Terms
We may update these Terms when the Service, subscription arrangements, business operations, or legal requirements change. Updated Terms will be published with a new effective date.
We will provide reasonable notice of material changes where practical. Continued use after the effective date constitutes acceptance except where express consent is required. Changes do not retroactively reduce rights relating to an earlier payment or claim.
21. Governing law and disputes
These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law rules.
Before formal proceedings, the parties should attempt in good faith to resolve a dispute by contacting contact@augmented-edu.com. If unresolved, the courts of the State of Qatar have jurisdiction unless mandatory law permits or requires proceedings elsewhere.
22. General provisions
- Electronic communications: Notices may be provided through the Service, website, or registered email address.
- Force majeure: Neither party is responsible for failure caused by events beyond reasonable control, except for amounts already due.
- Assignment: Users may not transfer accounts or rights without written approval. We may transfer these Terms as part of a merger, reorganisation, business sale, or transfer to an affiliate, subject to law.
- Severability: If a provision is invalid or unenforceable, the remaining provisions remain effective.
- No waiver: Delay in enforcing a right does not waive it.
- Entire agreement: These Terms, Privacy Policy, Refund and Cancellation Policy, selected plan, and any signed order or service agreement form the agreement concerning the Service. A signed agreement prevails where directly inconsistent.
- Headings: Headings are for convenience and do not affect interpretation.
23. Language
These Terms may be provided in Arabic and English. Both are intended to have the same meaning. If an inconsistency arises, the version required or given priority by applicable law prevails.
